Sign Our Waiver Before You Fish!

LIABILITY RELEASE AND WAIVER — MAGIC MEMORIES FISHING

This Liability Release and Waiver ("Agreement") is entered into by the undersigned parent or legal guardian ("Participant") on behalf of the minor child(ren) identified in this form, in favor of Magic Memories Fishing, its owners, operators, staff, volunteers, and agents (collectively "Magic Memories Fishing").

1. ACKNOWLEDGMENT OF INHERENT RISKS

I understand and acknowledge that fishing and outdoor water activities involve inherent risks, including but not limited to: slips and falls near water, contact with fishing hooks and equipment, exposure to sun, heat, insects, and wildlife, accidental water contact, and other hazards associated with outdoor recreational activities. I understand these risks cannot be fully eliminated.

2. ASSUMPTION OF RISK

I voluntarily assume all risks associated with participation in activities organized or facilitated by Magic Memories Fishing, including risks arising from the negligence of Magic Memories Fishing, its staff, or its volunteers.

3. RELEASE OF LIABILITY

In consideration of my child(ren) being permitted to participate in Magic Memories Fishing activities, I, on behalf of myself, my child(ren), and our heirs, personal representatives, and assigns, do hereby release, waive, discharge, and hold harmless Magic Memories Fishing, its owners, staff, and volunteers from any and all claims, demands, damages, losses, causes of action, or liabilities of any kind arising out of or in connection with participation in any Magic Memories Fishing activity, whether caused by negligence or otherwise.

4. MEDICAL AUTHORIZATION

In the event of a medical emergency, I authorize Magic Memories Fishing staff to seek appropriate medical attention for my child(ren). I accept full financial responsibility for any medical care required.

5. PHOTO & VIDEO CONSENT

I grant Magic Memories Fishing permission to photograph and/or video record my child(ren) during activities. I consent to the use of these images and recordings for marketing, social media, website, and promotional purposes without compensation. I understand I may opt out by notifying staff before the activity begins.

6. CONFIRMATION OF GUARDIANSHIP

I confirm that I am the legal parent or guardian of the minor child(ren) listed in this waiver and that I have full authority to execute this Agreement on their behalf.

7. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Kern County, California.

8. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

9. VOLUNTARY EXECUTION

I have read this Agreement carefully, understand its terms, and sign it voluntarily. I acknowledge that I am giving up substantial legal rights by signing this waiver.
